1. Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “Employer,” or “Candidate,” as applicable) and ProperPune.com (“the Platform,” “we,” “us,” or “our”) governing your access to and use of the website https://properpune.com/ and all related services.
By accessing the Platform, registering an account, posting a job, submitting a job application, uploading a CV, or otherwise using any feature of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you are not authorized to use the Platform and must immediately cease all access.

2. The Platform – Nature of Service

ProperPune.com is an online intermediary platform as defined under the Information Technology Act, 2000 and the Intermediary Guidelines, 2021. The Platform provides a digital marketplace that enables:

  • Employers to create accounts, post job vacancies, and search for suitable candidates;
  • Candidates to create accounts, build profiles, upload CVs, and apply for job vacancies posted by Employers.

IMPORTANT DISCLAIMER – NO ROLE IN RECRUITMENT:  ProperPune.com is purely a technology platform facilitating connections between Employers and Candidates. We do not:

  • Participate in, manage, or oversee the recruitment, selection, interview, or hiring process;
  • Screen, verify, or endorse any Employer or Candidate listed on the Platform;
  • Guarantee job placement, employment, or any particular outcome from use of the Platform;
  • Act as an employment agency, recruiter, or staffing firm;
  • Represent either Employers or Candidates in any employment-related transaction.

All decisions relating to hiring, employment offers, interviews, and terms of employment are made exclusively between the Employer and the Candidate. ProperPune.com bears no responsibility or liability for any such decisions or their consequences.

4. Account Registration and Security

4.1 Account Creation
Both Employers and Candidates must register for an account to access certain features of the Platform. You agree to:

  • Provide accurate, current, and complete information during registration;
  • Maintain and promptly update your account information to ensure it remains accurate;
  • Keep your login credentials confidential and not share them with any third party;
  • Immediately notify us at info@properpune.com if you suspect unauthorized access to your account.

4.2 Account Security
You are solely responsible for all activities that occur under your account. ProperPune.com shall not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

4.3 Accurate Information Obligation
You represent that all information provided during registration, profile creation, job posting, or at any other time on the Platform is truthful, accurate, and does not violate any applicable law, third-party right, or these Terms. Providing false or misleading information is a breach of these Terms and may result in immediate account suspension or termination.

5. Terms Specific to Employers

5.1 Employer Account Creation:
Employers may register on the Platform by providing accurate company and contact information. Employers are responsible for ensuring that the person registering the account is duly authorized to represent the company or organization.

5.2 Job Posting Fees:
Posting job vacancies on the Platform requires payment of applicable fees as specified on the Platform at the time of posting. By submitting a payment for a job posting, you agree that:

  • Fees are non-refundable once a job posting is published, except as expressly stated in our Refund Policy or as required by applicable Indian consumer protection laws;
  • ProperPune.com reserves the right to revise its fee structure at any time with prior notice on the Platform;
  • GST and other applicable taxes will be charged as per prevailing Indian tax laws;
  • You are responsible for the accuracy of billing information provided.

5.3 Job Posting Content Standards:
Employers agree that all job postings published on the Platform shall:

  • Represent genuine, bona fide employment opportunities;
  • Be accurate, truthful, and not misleading to Candidates;
  • Comply with all applicable Indian laws including the Equal Remuneration Act, 1976; the Maternity Benefit Act, 1961; the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995; and any other anti-discrimination law;
  • Not discriminate against candidates on the basis of religion, race, caste, sex, gender, place of birth, disability, or any other ground prohibited by law;
  • Not contain false salary information, misleading job descriptions, or fraudulent employment schemes;
  • Not advertise multi-level marketing, pyramid schemes, or any illegal business model.

5.4 Employer’s Responsibility for Recruitment: 
Employers are solely responsible for verifying the credentials, qualifications, background, and suitability of any Candidate before making any hiring decision. ProperPune.com does not verify Candidate credentials and makes no representation regarding the accuracy of information provided by Candidates.

5.5 Employer’s Data Obligations:
Employers accessing Candidate data through the Platform agree to:

  • Use Candidate information exclusively for the purpose of evaluating job applications for vacancies posted on the Platform;
  • Not use Candidate information for unsolicited marketing, spam, or any purpose unrelated to recruitment;
  • Comply with all applicable data protection laws when handling Candidate personal data;
  • Maintain appropriate security measures to protect Candidate information received through the Platform.

6. Terms Specific to Candidates

6.1 Free Access:
Candidates may access and use the Platform’s core features free of charge, including account creation, profile building, CV upload, job search, and job application.

6.2 Candidate Profile and CV:
By creating a profile and uploading a CV on the Platform, Candidates agree that:

  • All information provided in their profile and CV is accurate, truthful, and up-to-date;
  • They own all rights to the content they upload, or have obtained all necessary permissions;
  • By submitting an application for a job posting, they expressly consent to the relevant Employer viewing their profile and CV;
  • They will promptly update their information if it changes.

6.3 Job Applications:
Submitting a job application on the Platform constitutes your authorization to share your profile and CV with the respective Employer. Candidates acknowledge that:

  • com does not guarantee any interview, job offer, or employment as a result of any application;
  • Employers, not ProperPune.com, are solely responsible for their recruitment decisions;
  • com has no obligation to follow up on job applications or communicate recruitment outcomes on behalf of Employers.

6.4 Candidate’s Responsibility:
Candidates are responsible for conducting their own due diligence before applying for a job, attending an interview, or accepting any offer of employment. Candidates are strongly advised to:

  • Independently verify the legitimacy of any Employer and job opportunity;
  • Not share sensitive financial or personal identity information (e.g., Aadhaar, PAN, bank details) with an Employer until they have independently verified the Employer’s authenticity;
  • Report suspicious or fraudulent job postings to ProperPune.com at info@properpune.com.

7. Prohibited Conduct

All Users are strictly prohibited from the following conduct on or in connection with the Platform:

7.1 Content Violations:

  • Posting false, fraudulent, misleading, or deceptive content;
  • Uploading content that infringes any intellectual property right, copyright, trademark, or other proprietary right of any person;
  • Posting content that is offensive, obscene, pornographic, hateful, defamatory, or promotes discrimination;
  • Posting content that violates any applicable law or regulation.

7.2 System and Security Violations:

  • Unauthorized access to or tampering with the Platform’s systems, servers, or databases;
  • Introducing viruses, malware, or other harmful code into the Platform;
  • Circumventing any security, authentication, or access control feature of the Platform;
  • Scraping, crawling, or automated extraction of data from the Platform without prior written permission.

7.3 Misuse of Platform:

  • Impersonating any person or entity or misrepresenting your affiliation with any person or entity;
  • Using the Platform to promote pyramid schemes, Ponzi schemes, multi-level marketing, or fraudulent investment opportunities;
  • Using Candidate or Employer data obtained through the Platform for purposes other than as expressly permitted by these Terms;
  • Creating multiple accounts for the same individual or entity without authorization;
  • Attempting to solicit Candidates or Employers away from the Platform to bypass payment obligations.

8. Intellectual Property Rights

All content on the Platform, including but not limited to the website design, layout, graphics, logos, text, software code, database structure, and interface elements, are the intellectual property of ProperPune.com and are protected under the Copyright Act, 1957 and other applicable Indian intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purposes as described in these Terms. You may not:

  • Copy, reproduce, distribute, or publicly display any content from the Platform without prior written permission;
  • Create derivative works based on the Platform’s content or design;
  • Remove or alter any copyright, trademark, or proprietary notices on the Platform.

User-generated content (job postings, CVs, profile information) remains the intellectual property of the respective User. By submitting such content on the Platform, you grant ProperPune.com a non-exclusive, royalty-free, worldwide license to use, display, store, and process such content solely for the purpose of operating the Platform and providing services.

9. Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE EXTENT PERMITTED BY APPLICABLE LAW. PROPERPUNE.COM EXPRESSLY DISCLAIMS:

  • Any warranty that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components;
  • Any warranty regarding the accuracy, completeness, reliability, or suitability of any information on the Platform;
  • Any warranty that job postings represent genuine employment opportunities;
  • Any warranty regarding the quality, suitability, or fitness of any Candidate or Employer;
  • Any warranty of successful employment outcomes resulting from use of the Platform.

10. Limitation of Liability

To the fullest extent permitted by applicable Indian law, ProperPune.com, its directors, officers, employees, agents, and affiliates shall not be liable for:

  • Any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use the Platform;
  • Any employment decision, offer of employment, or terms of employment agreed between an Employer and a Candidate;
  • Any fraud, misrepresentation, or misconduct by any Employer or Candidate;
  • Any loss arising from reliance on information posted on the Platform;
  • Any interruption, suspension, or termination of the Platform or any of its features;
  • Any unauthorized access to or alteration of your account or data resulting from events beyond our reasonable control.

In any event, ProperPune.com’s total aggregate liability to any User for all claims shall not exceed the fees paid by such User to ProperPune.com in the six (6) months preceding the claim.

11. Intermediary Disclaimer

ProperPune.com functions as an “intermediary” as defined under Section 2(1)(w) of the Information Technology Act, 2000. In its capacity as an intermediary, ProperPune.com:

  • Does not initiate, select the receiver of, or modify the information contained in job postings or Candidate profiles;
  • Is not responsible for the content of job postings or Candidate profiles as it is third-party content;
  • May, upon receiving actual knowledge of unlawful content or a valid complaint, take action including removing such content.

ProperPune.com complies with its obligations under the Intermediary Guidelines, 2021, including maintaining a grievance redressal mechanism and publishing its policies in accordance therewith.

12. Compliance with Indian Employment Laws

Employers using the Platform acknowledge their sole responsibility to comply with all applicable Indian employment and labour laws, including but not limited to:

  • The Industrial Disputes Act, 1947;
  • The Minimum Wages Act, 1948;
  • The Payment of Wages Act, 1936;
  • The Employees’ Provident Funds and Miscellaneous Provisions Act, 1952;
  • The Employees’ State Insurance Act, 1948;
  • The Maternity Benefit Act, 1961;
  • The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013;
  • The Equal Remuneration Act, 1976;
  • The Contract Labour (Regulation and Abolition) Act, 1970;
  • The Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017;
  • Any other applicable central or Maharashtra state labour legislation.

ProperPune.com makes no representation regarding compliance of any Employer’s hiring practices with applicable law.

13. Termination and Suspension

13.1 Termination by User:
Users may terminate their account at any time by contacting us at info@properpune.com or using the account deletion feature (if available). For Employers, any active and paid job postings at the time of termination will remain on the Platform until their scheduled expiry, after which no refund will be issued for the remaining posting period.

13.2 Termination by ProperPune.com:
ProperPune.com reserves the right to suspend or terminate any User account with immediate effect, without prior notice, if:

  • The User breaches any provision of these Terms or the Privacy Policy;
  • The User engages in fraudulent, illegal, or harmful conduct on or through the Platform;
  • Required to do so by applicable law or a government order;
  • We reasonably believe that continued access poses a risk to other Users or the integrity of the Platform.

13.3 Effect of Termination:
Upon termination, your right to access and use the Platform ceases immediately. Provisions of these Terms that by their nature survive termination (including limitations of liability, intellectual property provisions, dispute resolution, and governing law) shall continue to apply.

14. Dispute Resolution

14.1 Amicable Resolution:
Any dispute, difference, or claim arising out of or in connection with these Terms or the use of the Platform shall first be attempted to be resolved amicably by the parties through negotiation. Users may raise a complaint with our Grievance Officer at info@properpune.com.

14.2 Governing Law and Jurisdiction:
These Terms and any dispute arising therefrom shall be governed by and construed in accordance with the laws of India. The courts at Pune, Maharashtra, shall have exclusive jurisdiction over all disputes arising out of or relating to these Terms or the Platform, subject to applicable law.

14.3 Arbitration:
If amicable resolution is not achieved within 30 days, the dispute may be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, as amended. The seat of arbitration shall be Pune, Maharashtra, India, and proceedings shall be conducted in English.

15. Modifications to Terms

ProperPune.com reserves the right to amend, update, or modify these Terms at any time. Revised Terms will be posted on the Platform with an updated effective date. For material changes, we will provide notice via email or a prominent notice on the Platform. Your continued use of the Platform after the revised Terms are posted constitutes your agreement to the revised Terms.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed from the Terms, and the remaining provisions shall continue in full force and effect.

17. Waiver

No failure or delay by ProperPune.com in exercising any right or remedy under these Terms shall constitute a waiver of such right or remedy. A waiver of any breach shall not constitute a waiver of any subsequent breach.

18. Entire Agreement

These Terms, together with the Privacy Policy and any other policies or notices published on the Platform, constitute the entire agreement between you and ProperPune.com with respect to the subject matter hereof and supersede all prior and contemporaneous agreements, representations, and understandings.

  • Candidate: Any individual who creates an account on ProperPune.com to search for employment opportunities, build a profile, upload a CV, and apply for jobs.
  • Employer: Any individual, company, firm, or organization that creates an account to post job vacancies on the Platform and pays applicable fees for such postings.
  • Personal Information: Any information that identifies or can identify a natural person, directly or indirectly.
  • Sensitive Personal Data or Information (SPDI): As defined under the IT (SPDI) Rules, 2011, including passwords, financial information, health data, etc.
  • Platform: The website https://properpune.com/ including all pages, subdomains, and related services.
  • Data Fiduciary: ProperPune.com, as the entity determining the purpose and means of processing personal data.
  • Data Principal: The individual to whom personal data relates (i.e., the User).

Note: ProperPune.com does not directly collect or store full credit/debit card numbers or banking credentials. Payments are processed through secure third-party payment gateways compliant with applicable PCI-DSS standards. We retain only payment confirmation records for accounting and compliance purposes.

4.2 For Employers

  • To create and maintain your Employer account;
  • To process payment for job posting fees and issue receipts/invoices;
  • To publish and manage your job postings on the Platform;
  • To provide access to Candidate profiles and CVs who have applied to your posted jobs;
  • To communicate with you regarding your account, job postings, and Platform services;
  • To comply with GST and other applicable taxation and financial reporting requirements.

4.3 General Purposes

  • To ensure the security and integrity of the Platform;
  • To detect and prevent fraud, misuse, spam, and unauthorized access;
  • To comply with applicable laws, legal processes, regulatory requirements, and government orders;
  • To resolve disputes and enforce our Terms and Conditions;
  • To analyze aggregate usage patterns for Platform improvement;
  • To communicate important notices, policy changes, and Platform updates.

5. Disclosure and Sharing of Information

ProperPune.com does not sell your personal information to third parties for their independent marketing purposes. We share personal information only in the following circumstances:

5.1 Between Employers and Candidates
The fundamental purpose of our Platform is to facilitate connectivity between Employers and Candidates. Accordingly:

  • Candidate profile information, CVs, and application details are made accessible to Employers whose job postings the Candidate has applied for;
  • Employer company name, contact details, and job posting details are visible to Candidates on the Platform.

By using the Platform, you expressly consent to this sharing as it is integral to the Platform’s function.

5.2 Service Providers and Technology Partners
We may share data with carefully selected third-party service providers who assist us in operating the Platform, including:

  • Cloud hosting and infrastructure providers;
  • Payment gateway and financial transaction processors;
  • Email and SMS communication service providers;
  • Analytics and performance monitoring services;
  • Cybersecurity and fraud prevention services.

Such third parties are bound by confidentiality obligations and are permitted to use your data only for the specific services they provide to us, consistent with this Privacy Policy.

7. Data Retention

When you interact with employers through communication channels outside the Platform (such as email or phone), your interactions are governed solely by the privacy policies of those parties and the terms agreed between you.

11. Grievance Officer

In accordance with the Information Technology Act, 2000, and the Intermediary Guidelines, 2021, ProperPune.com has appointed a Grievance Officer to address complaints or concerns regarding processing of personal data.

12. Children's Privacy
